Hawaii moves away from Louisiana, more toward Florida

Hawaii of all states, one of six where the Clinton “assault{sic}” weapons ban (“Violent Crime Control and Law Enforcement Act of 1994″) did not fully sunset in 2004, recently enacted two pieces of pro-Second Amendment legislation which were signed into law yesterday by Governor Linda Lingle.
SB 358 prohibits any person or government entity from seizing or confiscating firearms or ammunition from any individual who is lawfully in possession of the firearm or ammunition, during any time of national emergency or crisis. This assures that there can be no post-Katrina-esque seizure of firearms as there was in New Orleans in 2005.
The second bill enacted, SB0532, is the Hawaiian version of “Castle Doctrine” legislation, negating previous Hawaii law which required a homeowner to retreat from his or her own home when invaded by a criminal engaging in a felony. The new law provides that any real property owner shall not be liable to any perpetrator for any injury or death that occurs upon the real property rising out of the commission of certain felony offenses.
